Terms of Service
These terms are the agreement between you and Discovia. By creating an account you accept them. If you do not accept them, do not use the service.
1. What Discovia is
Discovia connects people with free product samples from partner brands. In return, you produce photos and video to the requirements the brand sets for that product, and you give us your honest opinion of it. Taking part is free and there is no subscription.
2. Who can take part
- You must be 18 or over. We ask for your date of birth to check this.
- You must live in a region we currently ship to.
- You need a valid Amazon account and, where a product requires it, a profile we can verify.
- You need a real shipping address where you can receive parcels.
- One account per person. Duplicate accounts may be closed.
3. Your account
Give us accurate information and keep it up to date, especially your shipping address. You are responsible for keeping your password secret, and for what happens under your account. Tell us straight away if you think someone else has access to it.
4. Applications and samples
- Samples are free to you. You never pay us, and we never ask for card details.
- Quantities are limited. Applying does not mean you will be selected.
- Selection is at our discretion, and is based on the profile answers a brand asks for.
- We can withdraw, substitute or delay a product, or cancel a batch, without notice.
- Samples are for your own use and for the content you agreed to produce. They are not for resale.
- There is no cash alternative.
- If you do not produce the content you agreed to, we may ask for the sample back, or close your account.
5. What we expect from you
- Produce the photos and video to the requirements shown on the product page.
- Show the product honestly, including anything you did not like.
- Follow the rules of any platform where you publish the content, including Amazon's.
- Keep anything we send you confidential until the brand says it is public.
6. Your content
You keep ownership of the photos, video and written feedback you create. By submitting them you give us and the brand that supplied the product a worldwide, royalty free licence to use, reproduce, edit and display that material in connection with the product and the service. This licence lasts as long as the material may reasonably be used, and ends when you ask us to stop using it, except where it has already been published by someone else.
You confirm that the material is yours to send, that it does not break anyone else's rights, and that anyone appearing in it has agreed to appear. We may remove material that breaks these terms.
7. Honest feedback, and how reviews work
Your opinion has to be your own. We do not ask you to write a positive review, and a brand cannot require one. If a brand asks you to change your opinion, tell us.
Where you publish a review or a video on another platform, you are responsible for following that platform's rules, including any rule about disclosing that you received the product for free. We may ask you to include a disclosure, and you agree to include it when we do. Content that breaks a platform's rules, or that misleads the people reading it, is not allowed here.
8. Conduct we do not allow
- Creating accounts for other people, or using someone else's identity.
- Selling, transferring or giving away a sample you received.
- Submitting material you did not make, including stock images or footage.
- Automated requests, scraping, or attempts to interfere with the service.
- Harassment of other members, our staff, or brand staff.
9. Third party products and platforms
Brand names, logos and trademarks shown on this site belong to their owners. Their appearance here does not mean they sponsor, endorse or are affiliated with Discovia. We are not affiliated with Amazon or with any other platform where you may publish content, and we do not control whether those platforms accept it.
10. Availability and changes to the service
We can change, pause or end any part of the service, including the products on offer. We aim to give notice of significant changes, but we do not have to.
11. Disclaimers
The service is provided as it is. We do not promise that any product will be available, that you will be selected, or that a parcel will arrive within a particular time, since delivery is handled by third parties. Product descriptions come from the brand, and we do not warrant that they are accurate.
12. Limit of our liability
To the extent the law allows, we are not liable for indirect or consequential losses, for lost profit, or for anything a third party platform does with your content. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
13. Ending the agreement
You can close your account at any time by writing to us. We can suspend or close an account that breaks these terms, that we believe is fraudulent, or that we are required to close by law.
14. Which law applies
These terms are governed by the laws of the jurisdiction in which Discovia is established. The details will be confirmed before we launch publicly. Nothing here removes consumer rights you have under the law of the country you live in.
